Agreement waiving rights of intended wife in property of intended husband.
Agreement made this _________, 19__, between _________, of _________, husband, and _________, of _________, wife. RECITALS: An agreement to marry is about to be entered into between the parties. The parties desire to settle the property [and certain other] rights of wife after such marriage. Husband is the owner of certain real property and certain personal property. Wife has full knowledge of the extent and probable value of the property now owned by husband (or recite all property owned by husband as in §5.569. Wife desires to waive and relinquish all her rights, including homestead rights (add any other rights relinquished as in 5.606, post), either as wife or widow, in and to any property now owned or afterwards acquired by husband: Therefore, in consideration of the proposed marriage and of the agreements of wife stated below, husband agrees to _________[insert provisions, if any, made for wife, such as for instance in §§5.598–5.607]. In consideration of above agreement of husband, wife agrees that she will not claim any right, title or interest in any property of husband (after death of husband) other than payments (or as the case may be) provided for in preceding paragraph, including any right belonging to her as wife or widow of husband to homestead rights (add any other rights relinquished) in the property of husband, and will, on request of husband or his representatives, sign and acknowledge, any written instrument concerning property of husband (or substitute broader provision in §5.608).
