In consequence of certain differences that have arisen between the parties they are now living separate and apart from each other, and a reconciliation of their differences and resumption of marital relations are deemed unlikely.

Husband desires to make provision for the separate maintenance of wife.

It is the desire of the parties that an agreement be achieved making a permanent settlement of the property rights of wife in the property of husband regardless of the kind or character of such rights that may have accrued by reason of the marital relationship to the end that the transfers and provisions made for wife shall be in lieu of any such rights or claim of wife in the estate or property of husband, whether now owned or later acquired.

It is the intention of the parties that regardless of whether they resume their marital relationship, remain separated, or seek an absolute divorce in a later action following the execution of this agreement, no testimony shall be taken with respect to support or property rights and the provisions contained with respect to such matters shall be forever controlling and binding on the parties, their heirs and executors and assigns.
