Contract as to sidewalks. We, _________, _________ and _________, all of the County of _________ and State of _________, for and in consideration of the advantages which will result to each and all of us who are owners of lots Nos. _________ and _________ and _________ and _________ in block No. _________ of the original Town of _________, now included in the corporate limits of the City of _________, State of _________, do hereby mutually agree with each other and bind ourselves and our heirs and assigns, and appropriate, set apart and use for sidewalk purposes the following parcels of land namely: A strip of ground _________ feet wide off the north side of lots Nos. _________ and _________ in block No. _________ and running the whole length of the lots, and to that end we mutually agree to and with each other that in case we erect or cause to be erected upon the lots or any part of the lots, any building or buildings after this date, we will set the building _________ feet south of the north line of the lots, and upon the erection of a building or buildings, we will construct and thereafter maintain upon the strip of _________ feet of ground a good substantial sidewalk at the proper grade; and that the strip of _________ feet shall never be reclaimed for the purpose of erecting buildings thereon or be used for any other than sidewalk purposes except by the unanimous consent of all the owners of the property in lots Nos. _________ and _________ expressed in writing, signed, sealed and acknowledged. It is understood that the strip of _________ feet or as much as may be needed, may be used by the parties who own the property for stairways into their several basements, and for the display of goods, wares and merchandise, but it is not the intention of the parties to this agreement to dedicate the strip of ground to the City of _________ or to the public, but to hold it as private property to be used as stated above and for our own convenience and profit.
