Illustrative agreements. Agreement is made _________, 19__, between _________, residing at _________, husband, and _________, his wife, residing at the same place. Recitals: There is pending in the _________ court of _________ county, state of _________, an action for divorce brought by wife against husband. The parties desire to settle their respective rights as to the property owned by them, without the necessity of a judicial determination: Therefore, in consideration of the mutual promises stated in this agreement, it is agreed as follows: 1. Husband agrees to: a. Convey to wife by warranty deed all his right, title and interest in and to the following-described property: _________. b. Pay wife $_____ per month, on the first day of each and every month after this date, so long as she shall live, unless she shall marries, in which event the payment of $_____ per month shall cease; and in case of his death prior to the death of wife the $_____ per month shall remain and continue an obligation against his estate. c. Pay the following debts contracted by wife and now outstanding: _________. d. Pay the attorney's fee of _________, for services in connection with the bringing of the action for divorce, of $_____. e. Execute as a part of this settlement, and in consideration of it, a will by the terms of which he will bequeath and devise to wife the following: _________. Husband further agrees that he will not make any other or future will revoking or changing such bequest and devise, unless wife remarries, in which event he shall have the right to devise and bequeath his property as to sees fit. 2. Wife agrees to accept the payments and conveyances to be made by husband, as provided for above, in settlement of all her rights in and to the property of husband, both real and personal, and in settlement of all claims and demands of every character arising out of the marital status of the parties, including costs, temporary alimony, permanent alimony, support and maintenance, right of family allowance and right to inherit, and all claims of every character and description held by wife against husband, save as provided in this agreement.
