Husband agrees, as of the date of this settlement, to execute as a part of this settlement, and in consideration of it, a will by the terms of which he will bequeath and devise to wife _________ of all of his estate of whatever kind, character, or description, whether in law or in equity, except, however, his interest in the home place located at or near _________, in the state of _________, to be hers absolutely and without reservation or restriction of any kind; and he further agrees as a part of this settlement and in consideration of it not to make any other or future will without bequeathing and devising to wife _________ of all of his estate with the exception of his interest in _________ property, unless wife remarries, in which event husband shall have the right to devise and bequeath his property as he sees fit. It is agreed that should husband make any other or future will, wife at the time not having remarried, without bequeathing and devising to wife _________ of his estate, that wife shall at once be entitled to have absolutely, and without reservation or restriction, _________ of the estate of husband, of whatever kind, character, or description, whether in law or in equity, and to have the same effectually assigned, transferred, and conveyed to her by husband, and to sue for and to recover the same of him in the event of his refusal or failure to forthwith assign, transfer, convey and deliver the same to her.
